It will be another month before three constituents from All Saints West who have challenged the independent status of former United Progressive Party (UPP) Member of Parliament, Anthony Smith, sees the case being heard in court.
The legal battle between MP Smith and his constituents was set to be called in the High Court yesterday, but the matter has been adjourned to December 3.
The UPP filed legal action challenging Smith’s independence as the All-Saints West Member of Parliament after he left the Party in July.
Smith now serves in the Cabinet of the ruling administration, and the UPP argues that he should not be considered an independent member of the House of Representatives.
Attorneys Kendrickson Kentish and King’s Counsel Justin Simon are representing the UPP in the case, and they insist that Smith’s role in the Cabinet conflicts with his claim of independence.
Legal documents have been submitted with support from constituents who are reportedly unhappy with Smith’s decision.
