Businessman convicted of sexual assault to be sentenced next year

The Indian businessman who was found guilty of indecent assault, an offence which occurred over two years ago, will have to wait until January 31, 2025 to know his fate.

When Prakashcandra Lohar appeared before Justice Ann-Marie Smith in the High Court, yesterday, for his sentencing hearing, his attorney Wendel Alexander said that he had not seen the probation report, which caused the matter to be adjourned.

However, the probation said that the report was delivered to Alexander’s office.

While Alexander was hoping that the matter could have been dealt with before next year, it had to be put back because Justice Smith would not be available next week due to travel plans.

Additionally, the prosecutor, Crown Counsel Curtis Cornelius, will be out of the state for two weeks in January and will not be back on island until the 27th of that month.  

Alexander said he wanted to study the probation report in order to do a good mitigation plea on his client’s behalf.

The delay was relayed to Lohar through the assistance of an interpreter.

Lohar was convicted of two counts of indecent assault, stemming from an incident on February 12, 2022.

He found himself being charged and before the court after he offered a woman a ride while it was raining. She subsequently accused him of performing sexual acts in front of her and other sexual misconduct.  

Lohar was granted bail last week after the court was informed that he was under suicide watch at His Majesty’s Prison and of his poor medical state, which caused him to be hospitalised for three days.
